These Terms of Service ("Terms") govern your access to and use of the Loyalty iCard website at loyaltyicard.com, the Loyalty iCard dashboard, mobile scanner application, and related services (collectively, the "Service") operated by Loyalty iCard LLC ("Company", "we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
Loyalty iCard provides a software-as-a-service ("SaaS") platform that enables businesses to create, manage, and distribute digital loyalty cards, membership passes, coupons, event tickets, and other digital wallet passes compatible with Apple Wallet and Google Wallet. The Service includes:

You must be at least 18 years of age to create an account and use the Service.
Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.
Subscriptions automatically renew unless cancelled before the end of the current billing period. You may cancel your subscription at any time through your dashboard. Cancellation takes effect at the end of the current paid period. No refunds are provided for partial billing periods.
You may upgrade or downgrade your subscription plan at any time. Upgrades take effect immediately; downgrades take effect at the start of the next billing cycle. We reserve the right to modify pricing with 30 days' notice.

Your use of the Service is also governed by our Privacy Policy. You acknowledge that you are responsible for complying with all applicable data protection laws regarding the personal data of your end-users (customers) that you collect through the Service.
You retain ownership of all data you submit to the Service. We will not sell, share, or use your customer data for any purpose other than providing the Service to you.
The Service and its original content, features, and functionality are and will remain the exclusive property of Loyalty iCard LLC. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.
To the maximum extent permitted by law, Loyalty iCard LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.
Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. You may export your data before termination through your dashboard.
We strive to provide uninterrupted access to the Service, but we do not guarantee that the Service will be available at all times. We may perform maintenance, updates, or experience outages that affect availability. We are not liable for any loss resulting from Service unavailability.
These Terms shall be governed and construed in accordance with the laws of the State of Nebraska, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Nebraska.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.
